The 63rd update to the Practice Directions

The 63rd Update to the Practice Directions, dealing with amendments to the Pre-Action Protocol for Judicial Review came into effect on 1 July 2013. It amends CPR 52 and 54 and implements the Government’s curtailment of judicial review proceedings reflecting the new reduced time limits and other changes made by The Civil Procedure (Amendment No.4) Rules 2013 Statutory Instrument 2013 No. 1412.

Where any application for judicial review is recorded as totally without merit under CPR 23.12, the claimant will not be able to request an oral reconsideration of the refusal of permission and any appeal against that decision is by way of a paper-only appeal to the Court of Appeal.
